Heard the parties.

This application is moved for withdrawal of amount deposited by the appellant/Acquiring Body in appeal. The learned advocate for the applicant has produced on record copy of the order dated 14.6.2024 passed in Civil Application No. 4285/2024, arising out of the same proceedings, wherein this Court allowed the applicants therein to withdraw 75% of the amount deposited along with accrued interest on furnishing usual undertaking and 25% of the amount of compensation with accrued interest thereon was directed to be invested in fixed deposit in any nationalized bank. Both the parties accept this position. In view of the same, following order.

ORDER

(i) Applicant is permitted to withdraw 75% of the amount deposited in this Court along with accrued interest thereon on furnishing usual undertaking to the satisfaction of the Registrar Judicial of this Court. Balance 25% of the amount of compensation with accrued interest thereon be invested in fixed deposit in any nationalized bank for a fixed term to be renewed till pendency of the appeal.
