This is an application for bail under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.0174/2019, registered at Nanded Rural Police Station, District Nanded, for the offences punishable under Sections 302, 307, 397, 398, 120-B, read with 34 of the Indian Penal Code and under Sections 3/25 & 27(2) of the Indian Arms Act and under Sections 3(1)(i), 3(II), 3(2), 3(4) of the Maharashtra Control of Organised Crimes Act.

Heard. Perused the First Information Report (FIR) and related papers.

I have gone through the material relied on. The Court is inclined to grant the applicant bail. It is, however, made clear that the trial Court shall not be influenced by this order and decide the case within time frame prescribed for the disposal. Hence, following order:

O R D E R

(i) The Bail Application is allowed.

(ii)The applicant be released on bail in connection with Crime No.0174/2019, registered at Nanded Rural Police Station, District Nanded, for the offences punishable under Sections 302, 307, 397, 398, 120-B, read with 34 of the Indian Penal Code and under Sections 3/25 & 27(2) of the Indian Arms Act and under Sections 3(1) (i), 3(II), 3(2), 3(4) of the Maharashtra Control of Organised Crimes Act, on his executing P. R. bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with surety bond of the like amount.

(iii)The applicant shall attend the concerned Police Station every day by 9.00 p.m. until conclusion of trial. (iv)The applicant shall not tamper with the prosecution evidence.
