IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO. 6855 OF 2015 MANIK TOLBARAO MULGIR
VERSUS
THE STATE OF MAHARASHTRA AND OTHERS ...
Advocate for Petitioner : Mr. P.G. Deshmukh h/f Mr. Y.P. Deshmukh and Mrs. Kulthe S. S.
AGP for Respondents: Mr. G.K. Naik-Thigle .....
CORAM : S. V. GANGAPURWALA AND V. K. JADHAV, JJ.
DATED : 8th JULY, 2015 P.C. :- 1.
Learned A.G.P. raises a preliminary objection that the petitioner has remedy of appeal. In the light of that, though Mr. Deshmukh, learned counsel for the petitioner strenuously tried to canvass the submissions on merits, we are not inclined to consider the same.
2.
Writ petition is disposed of with liberty to the petitioner to prosecute the remedy of appeal. All contentions are kept open. The forum where the appeal would be filed, shall consider the time spent in prosecuting the present writ petition. No costs. ( V. K. JADHAV, J.) ( S. V. GANGAPURWALA, J. ) rlj/
