Heard the learned Counsel for the respective parties. 2.
By way of present petition, the petitioner assails the order dated 19.03.2022 passed below Exhibit-5 by 10th Joint Civil Judge, Junior Division, Nanded in RCS No. 59 of 2022, whereby the application filed by the petitioner for grant of temporary injunction came to be rejected. The order of trial Court was confirmed by the order dated 05.05.2022 passed below Exh. 21 by District Judge-2, Nanded in Misc. Civil Appeal No. 33 of 2022.

This Court by order dated 17.05.2022 passed an interim relief thereby restraining the respondents temporarily from taking any
988wp5407.22 action against petitioner in view of the notice issued on 26.11.2021 under Section 260 of the Maharashtra Provincial Municipal Corporation Act. This interim order dated 17.05.2022 was continued from time to time.

Learned Counsel for the both parties submit that purpose would be served if this Court directs the trial Court to decide the suit within a stipulated period.

Therefore, without going into merits of the matter the trial Court is directed decide the suit within six months from today. 6.
The parties shall not seek unnecessary adjournments so as to decide the suit within a period of six months. 7.
In view thereof, the Writ Petition is disposed of by continuing the interim order dated 17.05.2022 passed by this Court till the trial Court decides the suit.

It is made clear that the trial Court shall consider the matter on its own merits without being influenced by the continuation of interim relief.
