BENCH AT AURANGABAD WRIT PETITION NO.5816 OF 2024 (Ram Tukaram Ingle Vs. The State of Maharashtra, Through it's Secretary and Others) Mr.R.B.Ade, Advocate for the Petitioner.
Mr.S.B.Pulkundwar, Advocate for Respondent Nos. 2 and 3. Mr.M.M.Nerlikar, AGP for Respondent No.1.
( CORAM : RAVINDRA V. GHUGE AND Y.G.KHOBRAGADE, JJ.) DATE : JUNE 20, 2024 PER COURT :
1.
Besides making an allegation that the water supply scheme has not been properly implemented, and the infrastructure is of an inferior quality, there are no details before us, even to ex-facie verify that the quality of the work is not up to the mark. The Petitioner concedes that he is not an expert in the field. The work is not done in his presence and he has not approached any expert body for seeking any assessment. A baseless allegation is made that the work is of an inferior quality.
2.
The Petitioner has moved an application under the RTI Act khs/June 2024/5816
- 2 - to the Gram Panchayat. Then he has approached the First Appellate Authority. Despite an order, he has not received the documents. He has, therefore, approached the State Commission and the proceedings are pending.
3.
Considering the above and since a Writ Petition is filed with no details and no research to indicate the element of inferior quality of work, this Writ Petition is disposed off. The Petitioner is at liberty to pursue the pending proceedings.
