PER COURT:- 1.

By an order dated 21.10.2020, this Court had directed the Education Officer (Secondary), Zilla Parishad, Dhule to decide the proposal and grant approval within one month from the receipt of the order. The said authority was represented before the Court and therefore, the date of the knowledge of the order would be the date of the pronouncement of the order since it was dictated in open Court. Compliance was therefore expected upto 31.11.2020.

The present Education Officer, Dhule has complied with the directions of this Court and has issued an order dated 15.07.2022. The learned Advocate for the petitioner is satisfied.

In view of the above, this petition is disposed off.

However, we direct the Chief Executive Officer, Zilla Parishad, Dhule to follow the due process of law and issue show cause notices to the then Education Officers (Secondary), who were duty bound to comply with the directions of this Court dated 21.10.2020. Replies shall be called for within 15 days and if the Chief Executive Officer is satisfied as regards any default on the part of any of the then Education Officers (Secondary), he shall initiate appropriate action, as is permissible in law by strictly following the principles of natural justice.

We are passing this order in view of the fact that none of the Education Officers have ever approached this Court by filing a Civil Application

(3) for seeking extension of time. The disobedience is writ large on the face of the record.

The learned Registrar (Judicial) as well as the learned A.G.P., shall place a copy of this order before the Chief Executive Officer, Zilla Parishad, Dhule for perusal and action.

Compliance report shall be tendered by the Chief Executive Officer, Zilla Parishad, Dhule to this Court, on or before 15.09.2022.
