When this Court has shown its disinclination to grant relief to the Applicant Sanjay in ABA/884/2023 and the Applicant No. 1 Datta in ABA/808/2023, learned Counsel for these Respondents, on instructions, seeks withdrawal of the Application.

Application stands dismissed as withdrawn as against these Applicants.

As far as Applicant No. 2 - Sangita in ABA/808/2023 is concerned, the allegation against her is that she was present on the spot at the time of occurrence of incident and that she has caused assault on the wife of the informant. Perusal of medical

certificate of wife of the informant shows that she sustained single injury, which is simple in nature. It is thus clear that in respect of offence punishable under Section 307 IPC may not apply. Applicant has no criminal antecedents.

Since the Applicant is lady and having regard to the role in the crime, this Court is inclined to protect liberty of this Applicant. Hence, the order:

O R D E R

(i) In the event of arrest the Applicant - Sangita in connection with C.R. No. 93 of 2023 registered with Beed Rural Police Station for the offences punishable under Sections 307, 324, 143, 147, 148, 149, 34, 504 and 506 of Indian Penal Code and Section 4/24 of Arms Act, she shall be released on bail on furnishing PR bond of Rs. 15,000 (Rupees Fifteen Thousand Only) with one solvent surety in the like amount.

(ii) She shall attend the concerned police station as and when required.

(iii)She shall not contact the prosecution witnesses directly or indirectly.

(iv) She shall not interfere with the evidence in any manner whatsoever.

(v) She is further directed to cooperate the investigating agency for further investigation.
