The present petition assails the order passed by the Respondent No.1 granting permission to the Respondent No.5 to shift Respondent No.6 - School from village Sirasgaon, Taluka Shrirampur to village Dhorjalgaon-ne, Taluka Shevgaon, District Ahmednagar. During the pendency of this writ petition, the Petitioners and Respondent Nos.5 and 6 have filed consent terms. In the said consent terms, it is agreed by Respondent Nos.5 and 6 that they will not admit students of particular villages.

As the permission is now not a subject matter of challenge in view of the consent terms, it is not necessary to go into the legality of the said order. The Respondent Nos.5 and 6, vide consent terms have taken upon themselves not to admit the students of the villages as detailed in the consent terms.

909 wp.5135.13.odt As such, the writ petition is dismissed as against Respondent Nos.1 to 4 and disposed of between the Petitioner Nos.1 and 2 and Respondent Nos.5 and 6 in terms of the consent terms, which is duly verified by the Registrar (Judicial) of this Court. Accordingly, the writ petition is disposed of. No costs. In view of disposal of writ petition, pending Civil Application No.4367 of 2014, also stands disposed of.
