Heard learned counsel for the applicant and learned APP for the State.

The applicant is seeking bail in Crime No.798 of 2022 registered with MIDC Police Station, District Ahmednagar for the offence punishable under Sections 341, 395 r/w 34 of the Indian Penal Code.

Nothing has been recovered from the applicant. The complainant has also not identified him. He is languishing in jail since long.

Learned APP would submit that the applicant hails from the State of Uttar Pradesh. Therefore, there is every possibility of his fleeing away. As against this, learned counsel for the applicant would submit that the applicant is residing in Ahmednagar and he would not
944-ba-946-2023.odt (2) leave Ahmednagar without the leave of the police station, till conclusion of the trial.

Hence, as observed above, there was no identification and recovery from the applicant. The charge sheet has been filed. Hence, he is entitled to bail. Hence, the following order :
ORDER
(i) Bail Application is allowed.
(ii) The applicant, Amar Singh Mathalluram Singh, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) with one solvent surety in the like amount in connection with the above crime, on the conditions that he shall not tamper with the prosecution witnesses.
(iii) The applicant shall not leave Ahmednagar without the permission of the Investigating Officer/PSO, MIDC Police Station, Ahmednagar till conclusion of the trial.
