Learned Advocate for the petitioner and respondent No.4 submit that there is no dispute between the two parties, As such, it is jointly submitted that the impugned order dated 27/12/2007 delivered by respondent No.2 / District Collector, Jalna be set aside by consent and respondent No.2 be directed to rehear the matter in the event any dispute still persists.

Mr.Nagargoje, learned Advocate for the petitioner submits that after this Court passes an order today, the petitioner would apply to respondent No.2 / District Collector to decide his application dated 02/05/2006 afresh.

Learned AGP submits that if the petitioner applies for a rehearing on the application dated 02/05/2006, the same would be decided within a period of 3 (three) months.

In the light of the joint statement recorded as above, the impugned order dated 27/12/2007 is quashed and set aside. The petitioner shall make an application within 3 (three) weeks from today to respondent No.2 / District collector seeking a rehearing on the application dated 02/05/2006. Needless to state, the learned District Collector shall decide application dated 02/05/2006, as expeditiously as possible and preferably on or before 30/06/2016. 5.

In the light of the above order, this petition is partly allowed and disposed of.
