The petitioners challenge the interim order passed by the revisional authority, where the revisional authority under the Mamlatdar Courts Act i.e. the Sub-Divisional Officer has refused to stay the order passed by the Mamlatdar under Section 5 of the Mamlatdar Courts Act. The learned counsel appearing for the applicants submits that there is a substantive revision petition pending before the revisional authority and, during the pendency of the proceedings the revisional authority ought to have stayed the order of the Mamlatdar.

This court issued notice, on 04.06.2025 and granted interim relief that during the pendency of the proceedings before the Sub-Divisional Officer the order passed by the Mamlatdar under Section 5 of the Mamlatdar Courts Act is stayed. Without going further in to the merits of the impugned order passed by the revisional authority, as it would prejudice either of the parties, I deem it appropriate to comfirm the interim order dated 04.06.2025 passed by this court and direct the revisional authority to decide the revision petition within two (02) months from the date of production of this order. The parties agreed that they would cooperate in disposal of the revision petition. 4.

The Writ Petition is allowed accordingly.
