IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD 907 WRIT PETITION NO. 6181 OF 2015 SHAIKH JAHUR SHAIKH AHMAD

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ...

Advocate for Petitioner : Maniyar Irfan D Mr. SG Karlekar, AGP for Respondent/State;

Mr. SK Kadam, Adv. for Resp.No.2.

__________ CORAM :

R.M.BORDE & P.R.BORA,JJ.

DATE :

th JUNE, 2015.

PER COURT :

1) Heard. The petitioner is objecting to the inaction on the part of respondents - State Cooperative Election Authority and District Cooperative Election officer in its failure to consider the objections raised by the petitioners positively for inclusion of their names in the final voters list prepared for conducting election of Respondent No.4Federation. 2) Name of the petitioner society has not been included in the list of voters, since the resolution, nominating the representative of the petitioner society for the purpose of elections to the Federal society, was not submitted by the primary society i.e. Yashwant Labour Co-operative Society Ltd., within prescribed time frame.

The petitioner contends that the federal society did not intimate

the cut off date prescribed for receiving the resolution, which has resulted in failure by the petitioner to tender name of the representative society. It is noticed that number of other societies have been included in the list of voters and it would be difficult to accept the contention of the petitioner that no intimation or notice was given to the petitioner. Even otherwise, since the process of election has been set in motion, the objections raised by the petitioner need not be considered. Keeping the option of the petitioner open to raise appropriate dispute at appropriate stage, the petition stands disposed of.
