For lack of particulars in the application before the learned Tahasildar, the parties are directed to approach the Tahasildar by making a fresh application on the basis of same cause of action.

The Tahasildar is directed to decide the proceeding afresh in appropriate manner keeping in view of sections 5, 7, 8 and 9 of the Mamlatdar Court Act as early as possible preferably within a period of three months from today.

Needless to say that impugned judgment and order dated 02-06-2022 passed by respondent No.2 in Revision No. 78/2021 is quashed and set aside.

Earlier arrangement, if any to continue till the decision of the proceeding before the Tahasildar.
