Perused the findings recorded by the Special Court. Prima facie, it appears that, those findings are not in consonance with the evidence brought on record by the prosecution. In that view of the matter, the case is established for allowing the application for seeking leave to appeal. Accordingly the application is allowed in terms of prayer clauses `B' and `C'. The application is disposed of.
