An innocuous prayer is put forth in the form of a request to Respondent No.4 Executive Engineer, Jaikwadi Irrigation Department, (North) Paithan, to deal with the representation of the Petitioners, dated 29.02.2024. The grievance is that, in every rainy season, whenever water accumulates in the Jaikwadi Dam, backwaters submerge the agricultural fields of the Petitioners. Every year, they lose their crops. They pray that the said land may be acquired. 2.

In view of the above, we are not issuing notice. Ends of justice would be met by directing Respondent No.4 to deal with the representation of the Petitioners dated 29.02.2024, provided he is vested with the jurisdiction to pass orders on the said representation and arrive at a conclusion. Let such exercise be completed within 90 days. In the event, the concerned authority concludes that it does not

926wp8225-24 have jurisdiction and the representation cannot be entertained by the said authority, the same be transmitted to any such authority which is competent to deal with the grievance of the Petitioners. The Petitioners should be informed accordingly.

The Petitioner shall serve a copy of this order on Respondent No.4, within two weeks from today.

All contentions of the parties are kept open. 5.

The Writ Petition is disposed off.
