This application is filed for withdrawal of the amount deposited by the acquiring body in this Court along with accrued interest. On going through the record, it is seen that the learned SLAO had granted rate of Rs.1400/- to Rs.1600/- per R. Same is enhanced to Rs.5593/-. The amount of enhanced compensation, thus, appears to be within four times the compensation awarded by the SLAO. Therefore, this Court is inclined to pass following order :-

ORDER

(i) The application is partly allowed.

(ii) The applicant is permitted to withdraw 75% of the amount deposited along with accrued interest on giving an undertaking that incase the appeal is allowed, the applicant shall re-deposit the amount along with interest within 12 weeks from the date of such order. (iii) The civil application is disposed off.
