Heard the learned counsel for the applicant for some time.

It appers from the Post Mortem Report that the probable cause of death is "Shock due to Gastrointestinal Bleed with underlying heart disease and associated with external genital injuries". It further appears that in response to the query made by the Investigating Officer, the Associate Professor of Forensic Medicine and Toxicology Medical College, Aurangabad and the Resident Doctor - Autopsy Surgeon, Department of Forensic Medicine Government Medical College, Aurangabad have
informed to the Investigating Officer that " As sequence of death events initiated due to sexual assault, the manner of death in this instant case is 'Homicidal' ". It further appears from the papers submitted today by the learned APP that the said team of the doctors further answered to the query of the Investigating Officer that the male DNA is detected in Exh.2 i.e. Swab from labia minora, Exh.3 - Swab from periurethral area and Exh.4 - Anal swab of Sakshi @ Rohini Balu Wadekar. It is further informed that comparative DNA profiling results will be given after receiving the control sample of accused. The learned APP submits that after this communication dated 26.06.2020 by the said team of the doctors to the Investigating Officer, the DNA sample of the applicant-accused has been collected and sent for comparative analysis.

The learned counsel for the applicant, on instructions seeks leave to withdraw this application with liberty to the applicant to file an application for regular bail before the Sessions Court after receipt of the DNA report. 4.
