Mr. Dande, learned counsel for respondent No.2 submits that, the issue involved in the present Writ Petition is no longer res integra in view of the judgment of this Court in the case of Waluj Industries Association, Aurangabad & ors. Vs. State of Maharashtra & ors., reported in 2009(2) Mh.L.J. 683. The learned counsel further submits that, after filing of the petition also, further rates are revised.
