The applicant was permitted to withdraw the anticipatory bail application No. 1105 of 2019. Accordingly vide order dated 09-09-2019 the application was disposed of as withdrawn. Whereafter on 07-12-2020 co-accused Masood Khan S/o. Kamal Khan was granted bail by this court. In this change circumstance the applicant applied for pre-arrest bail before the Additional Sessions Judge. The order dated 03-04-2021 passed in the said application shows it was withdrawn by the applicant with liberty to file an application afresh. In these circumstance, the applicant has approached this court.

In my view the applicant deserves to be granted liberty to approach the Sessions Court in view of change circumstance. As such the applicant is granted liberty to seek appropriate protection

(2) aba737.21 from the Sessions Court, Jalgaon. If the application is filed, the learned Sessions Judge shall decide the same on its own merits and in accordance with law.
