Heard for some time. The original appellant - respondent No.1, on instructions, makes a statement that in the appeal, wherein, the delay condonation application has been allowed and against which the present writ petition is filed, there is no relief claimed against the present petitioner. Considering the same the learned counsel appearing for respondent No.1, on instructions, makes a statement at bar that as the appeal is not being prosecuted against the petitioner and the same is being prosecuted only against the respondent Nos.2 to 4 herein (original respondents No.2 to 4 in the appeal) filed before the Maharashtra State Cooperative Appellate Court, the respondent No.1 will delete the present petitioner from the array of respondent No.1 in the said appeal.

Learned counsel appearing for the petitioner has no objection if the name of the petitioner is deleted from the array of respondents in the appeal filed before the Maharashtra State Cooperative Appellate Court. The respondent No.1 undertakes to carryout necessary amendment in the appeal within a period of three weeks from the date of service of this order.

Without going into the merits of the matter, this writ petition can be conveniently disposed of.

It is further made clear that the above order is passed only in the context of the subject matter of appeal filed before the Maharashtra State Cooperative Appellate Court, Aurangabad and not in respect of any other proceeding. With these directions the writ petition stands disposed of.
