Mr. Vibhute, the learned counsel for the petitioner submits that, the respondent No. 5 stands disqualified as respondent No. 5 has not submitted validity certificate within time stipulated U/Sec. 10(1)(A) of the Maharashtra Village Panchayat Act and subsequent amendment. Because of stay granted by the respondent No. 4, fresh elections are stayed, though the respondent No. 5 is disqualified. The learned counsel submits that, next date fixed before the respondent No. 4 is 10.07.2019.

Mr. Pulkundwar, the learned A. G. P. accepts notice for

2 wp 7381.19 respondent Nos. 1, 2 and 4 and submits that, Additional Commissioner would decide the proceedings on merits. 3.

Considering the aforesaid fact and statement made by the learned A. G. P., the respondent No. 4 shall decide the proceeding expeditiously after hearing all parties concerned. The writ petition is disposed of. No costs.
