Heard the learned counsel for the applicant and the learned A.P.P. for the respondent/State.

The applicant is seeking bail in C.R.No.40 of 2023 registered at Himayatnagar Police Station, District Nanded, for the offences punishable under Sections 376(1) and 506 of the Indian Penal Code.

Perused the papers. It appears that it was consensual sex. The victim was married. The investigation has been completed. Nothing is to be recovered from the applicant. They are residents of different villages. In the facts and circumstances of the case, the applicant deserves bail. Hence, the order:- i) Bail application is allowed.

ii) Applicant Sachin Ramesh Paulkar be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in the aforesaid crime, on the condition that he shall not tamper the prosecution witnesses. ( S. G. MEHARE, J. ) rrd
