DATED : 7TH JULY, 2015 ORDER :- This is an application for relaxation of condition. Heard Shri Desale, learned counsel for applicant and Smt.Bharad, A.P.P. for respondent State.
2] The present applicant is released on bail by this Court 24/3/2015 in Criminal Application No.1226/2015 in connection with Crime No.151/14 registered with Dhule city police station. While granting him bail, this court has imposed following condition : "iv] The applicant shall not enter the territorial jurisdiction of Dhule City police station till the conclusion of the trial."
3] The cause for moving present application is that now Sessions Case No.163/14 has fixed for hearing. It is submitted by learned
criapln3196-15 -2counsel that the Sessions Court is situated within the territorial jurisdiction of Dhule city police station. In fact, the applicant has placed necessary documents also in that behalf obtained by him through Right to Information Act.
4] The applicant is required to attend the Court of the learned Sessions Judge,Dhule in Sessions Case No.163/14 in which present applicant is granted bail by this court. In that view of the matter, it is absolutely necessary to relax the condition to said extent. That leads me to pass following order :
ORDER
A] Application is allowed. Condition No.(iv) imposed upon the applicant on 24/3/2015 in Criminal Application No.1226/2015 is relaxed to the following extent : (iv) The applicant shall not enter the territorial jurisdiction of Dhule City police station till the conclusion of the trial except on the date when the Sessions Case No.163/2014 is fixed.
B] With this, the application is disposed of.
