The learned advocate for the petitioner submits that, the transfer of the petitioner is not in consonance with the policy under the Government Resolution dated 15th May, 2014. The petitioner is required to be retained at the place within the periphery of 30 K.M. of his spouse. The petitioner's wife is working as Anganwadi Sevika at village Javdetah, Tq. Shahada. 2.

According to the respondents, the petitioner never mentioned in his application that the wife of the petitioner is working at village Javetah. He even did not mention said fact at

2 wp 6869.19 the time of counseling.

Unless the petitioner brings to the notice about the place of work of his wife to the respondents, the respondents would not get knowledge of it. In view of that, we cannot find fault with the respondents.

The petitioner may make an application with the Chief Executive Officer, Zilla Parishad, Nandurbar for placing the petitioner within periphery of 30 K.M. of the place of service of his wife, which application would be considered by the C. E. O. on its own merits. The decision shall be taken within a period of one (01) month from the date of application.

In view of the above, the writ petition is disposed of. No costs.
