1] Heard learned counsel for the petitioner, learned AGP for respondent NO.1 and learned Advocate for respondent Nos. 2 and 3. 2] Perused the pleadings in the petition, annexures thereto and reply filed by respondent Nos. 2 and 3. In para.2 of the said affidavit in reply, it is stated that in pursuance of the guidelines stipulated in the Government Resolution dated 22nd August, 2014, as well as the letter issued by the office of the respondent Zilla Parishad, it was directed to submit an application for request transfers from concerned teachers with mutual consent in prescribed format, to BDO on or before 1st November, 2014 and thereafter, the concerned BDO was supposed to submit the same to the office of respondent Nos. 2 and 3, for its proper scrutiny on or before 3 rd November, 2014.

3] This petition is filed seeking directions to the respondents to respondents to consider the representation dated 8th April, 2015, and 25th May, 2015 submitted by the petitioner in terms of provisions containing in

{2} 916 sr. no..odt Government Resolution dated 24th August, 2015. Admittedly, the petitioner and respondent No.4 have not filed heir application for mutual transfer with the Block Development Officer.

4] The petitioner and respondent No.4 will be at liberty to file such application/representation for mutual transfer with the Block Development Officer, Panchayat Samiti, Loha and Panchayat Samiti, Naigaon, within a period of 3 weeks from today. Upon filing such application/representation, the concerned BDOs to consider the same, in the light of relevant Government Resolution and forward it alongwith recommendation, to the Chief Executive Officer of the Zilla Parishad, Nanded, as expeditiously as possible, and preferably within 4 weeks from date of receipt of such application/representation from the petitioner and respondent No.4. Upon receipt of such proposal with recommendation from the BDOs, the respondent No.2 shall take final decision keeping in view the Government Resolutions/policy, as expeditiously as possible and preferably within 4 weeks from date of receipt of such proposal/recommendation from the BDOs.

5] Writ petition is disposed of in above terms. Parties to act upon authenticated copy of this order.
