Mr. Sawant, the learned Advocate for the petitioner submits that the petitioner has filed appeal before the School Tribunal, Nashik, against the termination effectuated by the respondent Nos. 1 and 2 / Institution at Dhule. Since one year the stay petition is pending. The respondent Nos. 1 and 2 have appeared, but every time the matter is adjourned at their behest. The School Tribunal be directed to decide the stay petition.

Learned AGP appears for respondent No. 3.

It will not be fruitful now to direct the School Tribunal to decide the stay petition. According to the petitioner, the services

38WP7988 were terminated about a year back.

Considering that the petitioner is terminated from the service, the School Tribunal where the appeal filed by the petitioner is pending shall endeavor to decide the appeal on its own merits, preferably within a period of eight months, after the hearing all parties concerned as per the procedure.

With the aforesaid observation, Writ Petition is disposed of. No costs.
