The learned A.G.P. submits that the petitioner has remedy before the Divisional Commissioner.

In the light of that, we are not inclined to enter into the merits of the contentions. The petitioner may approach the Divisional Commissioner within a period of one (01) week from today. The Divisional Commissioner shall after hearing all parties concerned take decision with regard to the grievance of the petitioner on its own merits, expeditiously and preferably within a period of one (01) month from the date the petitioner approaches the Divisional Commissioner, Aurangabad.

In case, the petitioner approaches the Divisional Commissioner within a period of one (01) week from today, then status quo as on today with regard to the post of the petitioner be maintained till the decision of the Divisional Commissioner.

Writ petition is disposed of. No costs.
