I have heard the submissions of Shri Bedre, learned Advocate for the petitioner at length. He has seriously criticized the impugned judgment dated 30.3.2016.

Shri Bedre submits, on instructions, that considering the fact that the original complainant has not termed the receipt dated 3.3.2013 as a promissory note and since the learned Magistrate has also arrived at a conclusion in paragraph No.8 of the impugned order, that the document is merely an acknowledgment receipt and is not a promissory note, the petitioner desires to withdraw this petition. 3.
In the light of the above, this petition is disposed off as withdrawn, on instructions.
