By these petitions, the petitioners have challenged orders dated 15th March, 2023 passed by the Member, Industrial Court, Latur, below Exhibit-U-2 in the Complaints filed by the petitioners, thereby rejecting the applications for stay to the transfer orders of the petitioners.

Indisputably, all the petitioners were transferred from their existing place of posting to some different depot, on administrative grounds and they challenged the transfer orders, by filing Complaints in the Industrial Court, Latur. Initially, on 28th September, 2021, ad interim relief was granted by the Industrial Court in favour of the petitioners, thereby granting stay to their transfer orders. By the orders impugned in the present petitions, the Industrial Court has rejected applications U-2 filed by the petitioners for stay to their transfer orders. Hence, these petitions.

Without entering into the merits of the matter, since the complaints filed by the petitioners are pending before the Industrial Court, Latur and as per the submission of the learned advocates for the parties, pleadings of the parties are complete and as the Industrial Court has stayed the impugned orders till 30th April, 2023, these petitions are disposed of by directing the

{3} Industrial Court to decide the Complaints filed by the petitioners within three months from the date of receipt of writ of this order. Till then, ad interim stay granted by the Industrial Court in favour of the petitioners shall continue to operate. Parties to cooperate. [NITIN B. SURYAWANSHI] JUDGE drp/wp6629-23.doc
