The objection tendered by the petitioner for inclusion of the name of the society in the final list of voters has been turned down by the Returning Officer for the reason that the petitioner society failed to communicate name of the nominee and did not tender resolution within the time stipulated to the federal society. 2.

Since the petitioner society did not communicate the name of nominee together with the proposal of the society prior to preparation of preliminary list of voters within the prescribed period, the grievance raised by the petitioner at belated stage, does not deserve consideration. The order passed by the Returning Officer cannot be said to be erroneous. The petition is devoid of substance and stands rejected.
