Heard learned Counsel for the applicant - wife. The respondent husband, though served, but remained absent. 3.

The applicant - wife is seeking transfer of HMP No.16 of 2021 pending in the court of Civil Judge (Senior Division), Osmanabad filed by respondent - husband for getting divorce to the Court of Civil Judge (Senior Division), Latur. According to the applicantwife, she is residing at Latur, which is 136 Kms away from Osmanabad. Moreover, she has also filed proceedings for getting maintenance at Chakur, District : Latur against respondent but he did not appear there. In view of the same, following order is passed.

ORDER

(i) The application is hereby allowed.

2 994 mca 321-21 (ii) The HMP No.16 of 2021 pending in the Court of Civil Judge (Senior Division), Osmanabad, is transferred to the Court of Civil Judge (Senior Division), Latur for disposal according to law. (iii) The respondent is directed to appear before Civil Judge (S.D.), Latur on 28/11/2022.

(iv) The application is disposed of accordingly.
