The learned counsel appearing for the Education Officer invited our attention to the contents of the letter dated 29th June, 2016 written by the Headmaster of the Respondent - School and submits that the resolution is passed by the Management to submit the proposal to
extend all pensionary benefits to petitioner no.1 and other admissible benefits to petitioner no.2. The learned counsel appearing for the petitioners submits that therefore, this Petition can be conveniently disposed of by giving direction to the Education Officer to act upon the pension proposal in respect of petitioner no.1 and proposal of other admissible benefits in favour of petitioner no.2.

In that view of the matter, the Education Officer will take expeditious steps. The learned counsel appearing for the Respondent - Education Officer in response to the arguments of the learned counsel appearing for the petitioner assures this Court that the Education Officer will take expeditious decision, after receiving the proposals from the management.

The learned counsel appearing for Respondent Nos. 4 and 5, on instructions, submits that those respondents will make every efforts to submit the proposals within four weeks from today subject to co-operation by the petitioners to expedite the said proposals.

In the light of discussion hereinabove, the order dated 21st June, 2016 to the extent of observing that respondent No.3 to take all possible actions against Respondent Nos. 4 and 5, within his jurisdiction and permissible limits stands recalled.

The Petition is disposed of in the above terms.

The parties shall act upon an authenticated copy of this order.
