The applicant is seeking his release on regular bail, in connection with Crime No. 44 of 2016, registered with Kurunda Police Station, Dist. Hingoli, for offences punishable under Sections 326, 325, 336, 323, 506(2) read with Section 34 of the Indian Penal Code. 2.

The applicant was arrested on 14th May, 2016 i.e. immediately on next day of the report. Apart from unexplained delay in lodging fist information report, already there is a recovery. The complainant has suffered simple injury.

In the above background, in my opinion, further detention of the applicant is not necessary and he is entitled to be released on bail. Hence, I pass following order :

criap3028.16 (2) The applicant be released on bail, in connection with Crime No. 44 of 2016, registered with Kurunda Police Station, Dist. Hingoli, for offences punishable under Sections 326, 325, 336, 323, 506(2) read with Section 34 of the Indian Penal Code, upon furnishing P.R. Bond of Rs 15,000/- with one surety in the like amount.

The applicant shall keep himself away from the jurisdiction of the concerned Police Station, till filing of charge-sheet. He shall not tamper the prosecution evidence and shall not influence on witnesses. Criminal Application stands allowed in above terms. (N.W. SAMBRE, J.) sjk
