The applicant is seeking regular bail in connection with Crime No.I-299 of 2020 registered with Newasa Police Station, District Ahmednagar for the offences punishable under Sections 307, 506, 504, 323 read with Section 34 of IPC. His application with similar prayer came to be rejected by the Additional Sessions Judge, Newasa, District Ahmednagar, vide order dated 19.09.2020 in Criminal Bail Application No.293 of 2020.

Though I find the name of the applicant is mentioned in the FIR with specific role attributed to him, however, it appears that the applicant is agriculturist by occupation and the incident had taken place on account of some dispute in respect of the water flowing from the canal in the agricultural land. There are no antecedents. The informant has sustained only one injury over the portion of the eye and though the said injury is greivous in nature, however, as a matter of punishment bail cannot be refused. The applicant has a fixed place of residence. By imposinig certain conditions, the applicant can be released on bail. Hence following order :
O R D E R

The application is hereby allowed.

The applicant Maruti S/o Sabaji Mane in connection with Crime No.I-299 of 2020 registered with Newasa Police Station, District Ahmednagar for the offences punishable under Sections 307, 506, 504, 323 read with Section 34 of IPC be released on bail on furnishing P.B. of Rs.15,000/-(Rupees Fifteen Thousand only) with one surety of the like amount on the following conditions :-
a] The applicant shall not tamper with the prosecution evidence in any manner.
b] The applicant shall attend the concerned police station once in a week i.e. on every Sunday between 8.00 to 11.00 a.m. for a period of three months from the date of this order.
