The learned Assistant Government Pleader raises a preliminary objection that the petitioner has alternate remedy before the Maharashtra Administrative Tribunal.

In the light of that, though Mr. Salgar, the learned counsel for the petitioner sought to canvass submissions on merits of the matter, we are not inclined to consider the same. The writ petition is disposed of with liberty to the petitioner to avail the alternate remedy. All contentions are kept open. The Tribunal where the proceedings would be filed, shall consider the time spent in prosecuting present writ petition.
