The Petitioner, Original Defendant No.2 in Regular Civil Suit No.142/2016, prays that the suit be decided within a stipulated period. 2.

It is well settled that a Writ of Mandamus to a Judicial officer cannot be issued, unless in rare and exceptional circumstances. So also, there are several litigants who are in queue before the Court. Merely because the Petitioner has preferred a Writ Petition for directions, would not warrant issuance of a Writ of Mandamus to the learned Judge to decide the suit out of turn.

In view of the above, this Writ Petition is disposed off. The learned Judge would deal with RCS No.142/2016 in queue with filing of cases considering the date of the lodging of this case. [Y.G. KHOBRAGADE, J.] [RAVINDRA V. GHUGE, J.] mub
