Perused the affidavit in reply filed by Respondent Nos. 1 to 4. In para 4 of the affidavit in reply, it is stated that, the Respondents have already absorbed 10 employees as per the vacancy available. It is further stated that, the petitioner's name is at Sr. No.75 in the list of surplus teachers and as soon as vacancy would arise, the petitioner will be absorbed.

The learned A.G.P. appearing for the Respondent/State has tendered across Bar the letter addressed by Assistant Commissioner, Social Welfare, Latur to the learned A.G.P.
6370.15WP Along with the said letter list of surplus junior clerks is annexed, wherein the name of the petitioner is shown at Sr. No.4. The same is taken on record and marked as `X' for identification.

The learned A.G.P., on instructions, submits that, as and when vacancy would arise the petitioner will be absorbed as junior clerk.

In that view of the matter, keeping in view the discussion in foregoing paragraphs and the serial number of the petitioner in the list of surplus junior clerks, the Respondents will take appropriate steps to absorb the petitioner as per his turn in the seniority list.

The Petition stands disposed of in above terms.
