Applicant is brother of complainant.

Applicant had allegedly relinquished his undivided share in the property, in favour of his brother (Complainant) for consideration of Rs.10,00,000/- and executed a document. Thereafter, applicant allegedly asserted his rights and did not cooperate complainant for mutating complainant's name in the revenue records. Complainant would therefore alleged that his brother has cheated him.

In my considered view the custodial interrogation of the

9aba752.21 applicant shall not further the prosecution case. In fact, complainant may adopt appropriate proceedings to protect his rights in the property. In consideration of the facts aforesaid, application is granted.

(i). In the event of arrest of applicant in connection with crime No. 224 of 2021, registered at Paithan Police Station, District Aurangabad, for the offence punishable under Section 420 of Indian Penal Code, he shall be released on bail on executing P.R. bond in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.

(ii).

The applicant shall report to the Investigating Officer, on Monday of each commencing date from of 26th July, 2021, in between 11:00 a.m. to 1:00 p.m. till the charge-sheet is filed. 5.

Application is allowed and disposed of.
