IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO. 7138 OF 2016 KAI MANOHAR KARKAR SHIKSHAN PRASARAK MANDAL THROUGH ITS SECRETARY RAHUL VASANT KARKAR.
VERSUS
THE STATE OF MAHARASHTRA AND OTHERS ...
Advocate for Petitioner : Shri Nagargoje Prashant M. AGP for Respondents 1 and 2 : Shri N.T.Bhagat. ...
CORAM: RAVINDRA V. GHUGE, J.
DATE :- 15th November, 2016 Per Court:
It is pointed out by the learned Advocate for the Petitioner that Respondent No.4 herein (Kirantai Chandrakant Patil), who is aggrieved with the impugned judgment dated 01.11.2012, has already filed Writ Petition No.2424/2013 which is admitted. I find from the record that Respondent No.4 in this petition, who filed Writ Petition No.2424/2013, is actually the aggrieved person, by the impugned judgment of the School Tribunal dated 01.11.2012. The Petitioner/ Management herein is Respondent No.2 in Writ Petition No.2424/2013 and is supporting Respondent No.4. The said petition has been admitted on 12.02.2014. No relief has been granted to Kirantai Patil.
*2* 20.wp.7138.16 In this entire petition, there is no whisper as to why the Petitioner/ Management has filed this petition after four years when Writ Petition No.2424/2013 has already been filed by Respondent No.4 (Kirantai Chandrakant Patil) who is supported by this Petitioner/ Management.
Considering the fact that there is no explanation set out in the memo of the petition for the delay caused in filing this petition and that the petition is already filed by an aggrieved litigant to which the Petitioner/ Management is a party, this Writ Petition is dismissed only on the ground of delay.
