Heard learned counsel for the applicants and learned counsel for insurance company.

Entire compensation amount is deposited as per the directions of this Court. Out of the five claimants, two are minor. Therefore, compensation of their share is to be invested in the fixed deposit till they attain majority.

Considering this circumstance, permission is granted to withdraw 50 per cent amount of compensation out of deposited amount, subject to condition that

ca8495.18 applicant nos. 1, 4 and 5 shall file written undertaking in the First Appeal to re-deposit the said withdrawn amount as and when directed by this Court. Remaining amount be invested in the fixed deposit in any Nationalized Bank till the disposal of First Appeal.

Civil Application is disposed of.
