Petition has been moved by original defendant no.1, purportedly aggrieved by the quantum of costs for setting aside no cross examination order dated 5-03-2016 passed by the 3rd Joint Civil Judge, Senior Division, Aurangabad on Exhibit-106 in regular civil suit no. 522 of 2005. 2.

Learned judge appears to have noted the antecedent events and in his discretion has imposed costs. 3.

Having regard to the reasons which have weighed with the court while passing impugned order and the court having
