DATED : 7 th July, 2015 PER COURT :- 1] Heard Shri Amit A.Mukhedkar, learned counsel for applicant and Shri U.S.Mote, learned Additional Public Prosecutor for the respondent/State.
2] The present application is for anticipatory bail. The applicant, who is Anganwadi Sevika is apprehending her arrest, in connection with Crime No. 57 of 2015, registered at Akhada Balapur police station, District Hingoli, for the offences punishable under Sections 468, 471, 420 r/w 34 of the Indian Penal Code.
3] This court has already granted interim protection in favour of the present applicant on 24.6.2015. While granting interim protection in favour of the present applicant, it was noticed by this court that the first information report is lodged against the present applicant on the basis of the order passed by the Chief Executive Officer on 24.6.2015. That time, a statement was made before this court by the learned counsel for the applicant that the caste claim of the applicant was not forwarded to the Scrutiny Committee and her caste certificate is not invalidated by the Scrutiny Committee.
crap3237.15 4] Today, when the matter was called, learned Additional Public Prosecutor Shri U.S.Mote submitted that the caste claim of the present applicant was never forwarded to the Scrutiny Committee and till today duly constituted Caste Verification Committee has not invalidated the caste certificate of the present applicant. Thus, the caste claim of the present applicant that she belongs to Scheduled Caste is not invalidated or disallowed by the competent authority. In that view of the matter, present application needs to be allowed.
