It appears that earlier Criminal Writ Petition No.186 of 2015 was filed by the petitioner wherein exception was taken to FIR in Crime No.262/2014 registered with Police Station, Ahmednagar, Dist. Latur on 24.9.2014 for offences punishable u/s 306 r.w. 34 of I.P.C. The said petition was dismissed as withdrawn.

According to the learned Counsel for the petitioner, this Court granted liberty to file present petition.

786.15crwp In our opinion, there is no change in circumstances inasmuch as, the earlier petition also took exception to the same FIR which is subject matter of the present petition.

In view of dismissal of earlier petition, this petition is also dismissed. However, the petitioner will have liberty to take recourse to an appropriate proceeding, in the event of filing of charge-sheet by the Investigating Officer.
