Heard learned counsel for the applicant-Intervenor-Acquiring Body and learned AGP for appellant-State. Perused the application. 2.
Admittedly, the State Government has preferred first appeal accompanied with application for condonation of delay agitating validity, propriety of the impugned judgment and award passed by the learned Reference Court in LAR NO.113 of 1999. The intervenor being part and parcel of the Government Agency is intending to join the proceeding of First appeal as co-appellant. Learned AGP has no objection for the same.

In view of nature of subject-matter, there is no impediment to allow the application. Accordingly, application is allowed in terms of prayer clause "B". Applicant-Intervenor is allowed to join the proceedings as co-appellant in this matter accompanied with appellant - State of Maharashtra. A requisite amendment be carried out to that effect within two weeks from today.
