Mr. Phatale, the learned advocate for the petitioner submits that, the respondent No. 2 has withheld the result of the petitioner's II year MBBS Summer 2019 examination on the ground that the petitioner has not submitted validity certificate. 2.

According to Mr. Sant, the learned advocate for the university, the petitioner was admitted as a scheduled tribe category candidate and as the petitioner was admitted as S. T. category candidate, the petitioner was required to produce the validity certificate.

On 30th August, 2021, we had asked the learned advocate

2 wp 7807.21 for the CET Cell to clarify the category from which the petitioner was admitted. Mr. Karlekar, the learned advocate for the CET Cell submits that, the petitioner was admitted from the physically handicapped category quota, meaning thereby the petitioner was not accorded the benefit of S. T. category. 4.

As the petitioner has not been accorded benefit of S. T. category and has been admitted from physically handicapped candidate category as clarified by the CET Cell, the university shall not withhold the petitioner's result of the II year MBBS examination only on the ground that the petitioner has not submitted the validity certificate. The petitioner for all purposes is considered from physically handicapped candidate category. 5.

With these observations the writ petition is disposed of. No costs.
