Read the communication. It appears that there is delay in disposing of the trial in a time bound manner for various reasons, however, learned Judge has sought time for two years for disposal of the matter. Learned Judge has also informed that accused No.1 is mostly responsible for the adjournment, as he might be more interested in getting the bail. However, it appears that there is witness list cited by the prosecution of only 34 witnesses. Learned Judge has stated many things about the difficulties that may crop up in future. However, it is for the learned Judge to find out the way and dispose of the matter in a time bound manner as directed by this Court.

I find no reason to grant extension of time for two years as sought by the learned Judge for disposal of the matter. However, considering the non co-operation on the part of accused No.1, I am

ba685.19 -2inclined to grant extension for a period of six months with condition that if any progress is shown in the trial, another extension for some more period may also be granted.

In view of above, extension of six months at present is granted with direction that the learned Judge shall dispose of the case on priority basis by day to day hearing, if possible. Learned Judge shall give short dates in the matter, if it is inevitable and further submit fortnightly report to the learned Sessions Judge about the progress of the case.

Inform the learned Judge accordingly.
