Mr.Nagarkar, learned counsel submits that the invalidation of the caste claim of the petitioner was set aside by this Court in writ petition No.1312/2006. The petitioner was selected, but the appointment order was not issued on the ground of the validity certificate. According to the learned counsel for the petitioner when the petitioner stood in the select list appointment order ought to have been issued to the petitioner. 2.

Learned counsel for the respondent supports the order.

The selection process is of the year 2008.

In the intergnum the caste claim of the petitioner was invalidated subsequently on 06.01.2017 the matter is remitted to the Committee.

The Select list cannot operate for 10 years. 10 years have already lapsed from the date of preparation of the select / wait list.

In light of the above no relief can be granted. Writ petition is disposed of. Rule discharged. No order as to costs.

In view of disposal of the writ petition, the civil application does not survive and disposed of.
