Heard learned counsel for the applicant and learned APP for the State.

The applicant seeks bail in Crime No.200 of 2024 registered with Bidkin Police Station, District Aurangabad for the offence punishable under Sections 363, 365 and 143 of the Indian Penal Code.

Learned counsel for the applicant has placed on record the copy of orders granting bail to the co-accused. He would submit that similarly situated co-accused have been granted bail. Learned APP has examined the role attributed to the applicant and concedes that the role attributed to this applicant is similar to the role attributed to the co-accused who have been granted bail. The applicant deserves parity. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant, Aslam Yunus Pathan, be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount in the above crime, on the conditions that; (a) The applicant shall not tamper with the prosecution witnesses.

(b) The applicant shall attend the concerned police station as and when called on written notice by the investigation officer till filing the charge sheet.
