This was the writ petition filed against the order of issue process in a private complaint filed by the respondent. The order of issue process has been assailed directly to this Court. The complaint is not as like wherein the legal heirs of the deceased may proceed with. It has been told that the respondent/complainant is no more. Hence, Nothing remained in the matter. The complaint before the learned Magistrate stands infructuous.
