In terms of the provisions of Section 155 of the Motor Vehicles Act, 1988 the appeal can be proceeded further without bringing the legal heirs of the respondent vehicle owner on record when the vehicle is properly insured by the vehicle owner. In view of the same and for the reasons stated in the Civil Application, the same is allowed in terms of prayer clauses "B", "C" and "D" and disposed off accordingly. ( V. K. JADHAV, J. ) vre/-
